NOTICE-READ THIS AGREEMENT -- BLACK HILLS RALLY AUGUST 6-12, 2008

PAYMENT DUE DATES DATES OF IMPORTANCE:

1. August 11, 2006, 1/3 deposit for space(s) for Rally 2008

2. May 1, 2008, Deadline for 1/3 deposit for spaces for Rally 2008

3. August 6, 2008, final balance due for 2008 Rally spaces (including late charges)

4. August 8, 2008, need to notify Mr. Al's if you intend to rent space(s) for Rally 2008

5. August 10, 2008, 1/3 deposit for space(s) rental for Rally 2008

NO REFUNDS ON DEPOSITS OR PAYMENTS:

PLEASE DO NOT ASK! We are sorry you may encounter unforeseen problems next year, however, the nature of our business requires advance notice to lease our spaces each year.

LATE PAYMENT AND FORFEITURE OF RENTED SPACES:

Lessee will be required to pay one-third deposit down toward their space(s) at the time this contract is signed. THERE WILL BE NO EXCEPTION TO THIS RULE. If you cannot afford to pay the deposit by 6:00 pm on the last Friday of Rally Week, you will forfeit any right to space(s) and they will revert back to Mr. Al's and become available to be rented to other interested parties.

As stated above, your May payment is due no later than May 1, 2008. If not received or postmarked by that date, a 10% late charge will be added. If the May payment is still not received by midnight of May 31, 2008, the Lessee will forfeit any deposit and space(s) and they will revert back to Mr. Al's and become available to be rented to other interested parties. If late charges are not included with your May Payment, they will be added and collected with the final payment due August 6, 2008.

IT IS YOUR RESPONSIBILITY TO NOTIFY MR. Al'S OF ANY CHANGE OF ADDRESS OR PHONE NUMBERS SHOULD YOU MOVE OR RELOCATE DURING THE YEAR. THIS INFORMATION IS NEEDED TO ANSWER AND ADDRESS QUESTIONS THAT MAY ARISE OR AFFECT THIS CONTRACT.


MISCELLANEOUS:

  • The Lessee shall pay all required taxes, licenses and special fees imposed by the State, County or City.

  • The Lessee shall not cause damage or harm to the building (example: there will be no nails, screws or staples put in the walls or ceiling except in designated areas).

  • If Lessee leaves their spaces(s) vacated of merchandise and/or personnel for a period of one normal Rally business day, it will be assumed that the Lessee has abandoned the space and it will revert back to Mr. Al's and become available to be rented to other interested parties. Lessee will still be responsible for any balance due and there will be no refund of money previously paid by the Lessee.

    RALLY WEEK HOURS:

  • (LESSEE)) Set up hours Thursday, August 2, 2008, and before will be from 9:00 am to 5:30 pm. (All set-up, loading, closing of booths, batching credit cards, etc. must be completed by this time as the doors to the building will be locked at 5:30 pm.

  • (PUBLIC) Thursday, August 2, 2008, Mr. Al's will be open to the Public from 9:00 am to 5:30 pm.

  • (LESSEE) Friday, August 3, 2008, thru Saturday, August 11, 2008, the doors will be open to the Lessee from 7:00 am to 11:00 pm. (Booths are to close at 10:30 pm to allow Lessee time to close up their respective booths, batching credit cards, etc.)

  • (PUBLIC) Friday, August 3, 2008, thru Saturday, August 11, 2008, Mr. Al's will be open to Public from 9:00 am to 10:30 pm.

  • (LESSEE) Sunday, August 12, 2008, Mr. Al's will be open to Lessee from 7:00 am to 5:30 pm. The doors will close at 5:30 on that date so Lessee either needs to be tore down and loaded by that time or will have to come back the following day at 9:00 am to finish tearing down and loading.

  • (PUBLIC) Sunday, August 13, 2006, Mr. Al’s will be open to the Public from 9:00 am to 5:00 pm.

  • Monday, August 14, 2006, Lessee should have all property removed from Mr. Al's no later than 5:30 pm.

    LESSOR'S HOUSE RULES:

  • There will be no sub-leasing of space (s). This includes the sharing of space(s).

  • There will be no suggestive or obscene material (as defined by lessor) sold or displayed.

  • No pets will be allowed (with exception of seeing eye dogs)

  • There will be no sale of tobacco products on the premises.

  • May not sell, use or possess illegal drugs on the premises.

  • No Public Address system or loud music will be played.

  • Lessee to stay within their designated marked spaces. (This includes all the Lessee's merchandise as well as Lessee's employees).

  • No nudity, reasonable dress code for Lessee and or their employees (as defined by Lessor) while on Mr. Al's premises.

  • Lessee has the responsibility, should they have a problem with another Vendor of Mr. Al's, to first talk to that Vendor before involving Lessor.

    Liability Release:

    I accept and assume full responsibility of any injury to me or to any of my property on the premises of Mr. Al's Swap Meet and I expressly release Mr. Al and the Management from any liability for any loss or injury. I am responsible for providing liability insurance for my business and providing leassor with proof of insurance at time of setup.



    IT WILL BE YOUR RESPONSIBILITY TO PROTECT YOUR SPACE BY COMPLYING WITH THE TERMS OF THIS AGREEMENT
    VIOLATION OF ANY OF THE ABOVE RULES CONSTITUTES FORFEITURE OF SPACE(S) AND PAYMENTS IMMEDIATELY.



    I FULLY UNDERSTAND THE ABOVE AND AGREE TO ABIDE BY THE CONTENTS CONTAINED THEREIN.
